1.0 About Testmyteeth
Testmyteeth Limited (“Testmyteeth”, “we”, “our” or “us”) is a company registered in England and Wales under company number: 13463546. Our registered address is at 12 Forge Drive, Claygate, Esher, Surrey, KT10 0HR. Please read these ‘Terms and Conditions’ (“Terms”) carefully so that you understand them as they are an agreement between you and Testmyteeth Limited and contains important information about your rights and obligations when you use our Website (www.testmyteeth.com)and Mobile Application (collectively referred as “Testmyteeth Services”).
Testmyteeth Services provide general wellbeing information only and are not intended to diagnose, provide medical advice, treat, cure or prevent any disease. If you experience or suspect any issues relating to your oral health you should always consult a medical professional. We have explained this in more detail in section 4.0 and we recommend that you read this section carefully.
2.0 When these Terms apply
2.1 By clicking the “I Accept” button or otherwise accessing, browsing or using the Testmyteeth Website or Mobile Application, you agree to comply with these Terms.
2.2 We recommend that you download these Terms for future reference.
2.3 YOU MUST NOT USE OUR WEBSITE OR MOBILE APPLICATION IF YOU DO NOT AGREE TO COMPLY WITH AND BE BOUND BY THESE TERMS.
2.4 If you breach any of these Terms, we may restrict or block your access to our Services.
2.5 These Terms and Conditions may be updated or amended as required. We will take reasonable steps to make you aware of any changes by updating the Terms on our Website and we will notify you if your rights change. If you do not agree to these updated Terms, you should not use our Website or Mobile Application. By continuing to use the Testmyteeth Mobile Application and Website, you agree to be bound by the most recent Terms. It is your responsibility to check the Testmyteeth Website regularly for updated versions of the Terms.
2.6 These Terms should be read in conjunction with our Privacy Policy, which can be found at www.testmyteeth.com/privacy-policy, this Privacy Policy details how your Personal Information will be used by us.
3.0 About Testmyteeth Services
3.1 Testmyteeth provides general informational tools through our Website and Mobile Application, which aim to raise greater awareness of your oral hygiene.
3.2 Testmyteeth Services provide general wellbeing information only and are not intended to diagnose, provide medical advice, treat, cure or prevent any disease. If you experience or suspect any issues relating to your oral health you should always consult a medical professional.
3.3 Testmyteeth does not provide services that in any way constitute medical advice, treatment or diagnosis.
3.4 Our Services are not suitable for managing dental emergencies or any other medical emergencies.
3.5 Our Services are not suitable for unrestricted use by persons under 16 (see section 14.0).
3.6 We need certain information from you in order to provide services. When you register as a user of the App you are asked to consent to our processing of your health data to the extent necessary for providing the Services.
3.7 Plaque Scan:
i) Our Plaque Scan tool available through our Mobile Application is a tool which allows you to upload photos of your teeth and receive general information (“Results”) about areas where plaque might be present within the captured image.
ii) When preparing to complete a plaque scan you may be required to use disclosing tablets, toothpaste, a toothbrush and other oral hygiene products. Testmyteeth Limited will not be held liable for any injuries, damages, losses and/ or costs associated with the use of any third-party product, Testmyteeth Service or information provided by any Testmyteeth Service when completing a Plaque Scan.
iii) You should always follow the manufacturers specific instructions when using any oral hygiene product and ensure you have understood any risks associated with using the product. If you have any concerns or questions about using a new oral hygiene product you should always consult a medical/ dental professional.
iv) You understand and accept that any resulting information you receive from completing a Plaque Scan through our Mobile App may not be reliable, suitable, accurate or complete.
3.8 Assistant:
i) Our “Assistant” pages available through our Mobile Application and our Blog Articles available through our Website provides basic educational information on oral hygiene products, techniques, common issues and treatments that may be of interest to you.
ii) The order in which this information is listed does not in any way indicate the likelihood of the user having or not having a condition.
iii) You understand and accept that any information you receive from our Assistant function may not be reliable, suitable, accurate or complete. Testmyteeth will not be held liable for any injuries, damages, losses and/ or costs associated with the use of our Assistant feature or information provided by content found via our assistant feature.
3.9 Blog:
i) Our Blog posts available through our Website provides basic educational information on oral hygiene products, techniques, opinion based articles, common issues and treatments that may be of interest to you.
ii) The order in which this information is listed does not in any way indicate the likelihood of the user having or not having a condition.
iii) You understand and accept that any information you receive from our Blog may not be reliable, suitable, accurate or complete.
3.10 Appointments:
i) Our “Appointments” pages available through our Mobile Application displays information, services and products provided by third parties and contains links to third party websites where you can book an appointment with a dental professional if you would like to do so.
ii) Dental providers displayed in the “Appointments” pages of our Mobile application are not to be interpreted as: (a) a recommendation or endorsement by Testmyteeth of that dental provider, (b) confirmation of the status of the provider’s registration with their registration body, such as the General Dental Commission (GDC), (c) an acknowledgment or representation by Testmyteeth as to fitness for purpose of any products or services provided by any provider, (d) a warranty or guarantee by Testmyteeth of, for, or in relation to any product or service of the provider.
iii) When clicking the “Book Appointment” button you leave Testmyteeth Services and are taken to the Advertising Dental Practices Website or online Booking Service.
iv) Testmyteeth takes no responsibility for any of the content on the “Appointments” pages of our App. In addition, we are not responsible for any advice or consultation provided by dental professionals booked through our Mobile Application. Please pay attention to section 11.0 (Links to External Websites).
4.0 Medical Disclaimer
4.1 Testmyteeth Services provide general wellbeing information only and are not intended to diagnose, provide medical advice, treat, cure or prevent any disease.
4.2 Testmyteeth Services should never be used as a replacement or substitute for a qualified medical professional. If you experience any issues relating to your oral health, you should always consult a dental or medical professional. If you have any questions about a medical condition you should always seek advice from a qualified medical or dental professional. If you think you have a medical emergency, you should call your dental professional, doctor or the emergency services immediately. Any decisions you make affecting your health should always be made in consultation with a dental professional or doctor, and not on the basis of any Testmyteeth Service.
4.3 You understand and accept that any information you receive from Testmyteeth Services may not be reliable, suitable, accurate or complete and that except as otherwise provided for in these terms, Testmyteeth will not be held liable for any injuries, damages, losses and/ or costs associated with the use of any Testmyteeth Service or information provided by any Testmyteeth Service.
5.0 Accessing our services
5.1 You are responsible for making all arrangements necessary for you to have access to our Website and Mobile Application.
5.2 We do not guarantee that our site, mobile application, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site or mobile application without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period.
5.3 Where possible, we will try to give you advance warning of maintenance issues but shall not be obliged to do so.
5.4 You are responsible for ensuring that all persons who access the Website through your internet connection are aware of these Terms, and that they comply with them.
6.0 Use of your personal information
6.1 We use your personal information in accordance with our Privacy Policy which can be found at www.testmyteeth.com/privacy-policy. Please take the time to read it as it includes important details about how we secure and process your data.
7.0 Your Account
7.1 For full access to Testmyteeth Services you will need to create an account with us.
7.2 If you choose, or you are provided with, user details, a password and or authentication details as part of our security procedures, you are responsible for keeping this password and/or authentication method confidential. You must not disclose it to any third party.
7.3 We have the right to disable any user details, password or any other authentication details as part of our security procedures, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.
7.4 If you know or suspect that anyone other than you knows your user details or password, please contact support@testmyteeth.com.
8.0 Your Content
8.1 Testmyteeth may allow you to upload, store, share, post, send, or display photos, images, video, data, text, music, oral hygiene scores, comments, and other information and content (“Your Content”) to and via the Testmyteeth Website and Mobile Application.
8.2 By uploading Your Content via our email, the Testmyteeth Website or Mobile Application, you grant us a non-exclusive, worldwide, royalty free, fully paid up, transferable, sublicensable, perpetual, irrevocable license to use, store, modify (where reasonably necessary), copy and publish Your Content for the purposes of our operations and improving Testmyteeth Services and algorithms.
8.3 You are solely responsible for Your Content. By making available Your Content, you represent and warrant that you own Your Content or that you have all the rights or authorisations necessary to grant us a license to use Your Content as described in section 8.2 and as otherwise set out in these Terms. If you are a consumer user, this means you will be responsible for any loss or damage we suffer as a result of Your Content breaching these Terms.
8.4 You represent and warrant that Your Content, the use and provision of Your Content on Testmyteeth Services, and your use of our Services will not:
i) misappropriate, violate or infringe, a third party’s patent, copyright, trademark, trade secret, moral rights, or other intellectual property rights, or rights of publicity or privacy.
ii) be false, fraudulent, misleading, or deceptive.
iii) violate, or encourage any conduct that would violate, any applicable law or regulation or would give rise to civil liability.
iv) be offensive, vulgar, defamatory, obscene or pornographic.
v) promote discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group.
vi) promote criminal, illegal or harmful activities or substances.
8.5 Testmyteeth reserves the right, in our absolute discretion, to block, modify, monitor or remove any Content (including Your Content) without notice and will not be liable in any way for possible consequences of such actions.
8.6 Testmyteeth also reserves the right to disclose your identity to any third party who is claiming that any content uploaded or submitted by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.
8.7 The views expressed by other users on our Services do not represent the views or values of Testmyteeth.
8.8 If you have a complaint regarding any Content on our Mobile Application or Website, contact us at support@testmyteeth.com. If we deem appropriate, in our sole discretion we may review, modify or remove the particular Content.
9.0 Activation Codes, Fees and Purchase Terms
9.1 When using Testmyteeth services you may purchase with “real world” money, or unlock via activation codes, a limited personal, non-transferable, non-sublicensable, revocable right to use Virtual Items, including but not limited to digital scans, all for use in unlocking in-app, content or features; You are only allowed to purchase Virtual Items from us or our authorised partners through the Service, and not in any other way.
9.2 You agree that Testmyteeth will start the performance of the purchase agreement of Virtual Items or any other digital content before the expiration of any statutory withdrawal period defined in applicable laws. You give explicit prior consent that the content you have purchased will be delivered to you before the withdrawal period ends and you thereby loose the statutory right of withdrawal.
9.3 Testmyteeth may manage, regulate, control, modify or eliminate Virtual Items at any time, with or without notice. To the fullest extent under applicable law, Testmyteeth shall have no liability to you or any third party in the event that Testmyteeth exercises any such rights.
9.4 The transfer of Virtual Items is prohibited except where expressly authorised in the Service. Other than as expressly authorised in the Service, you shall not sell, purchase, redeem or otherwise transfer Virtual Items to any person or entity or attempt any of the aforesaid, including but not limited to Testmyteeth, another user or any third party.
9.5 ALL PURCHASES AND REDEMPTIONS OF VIRTUAL ITEMS MADE THROUGH THE TESTMYTEETH MOBILE APPLICATION ARE FINAL AND NON-REFUNDABLE EXCEPT WHERE REQUIRED UNDER APPLICABLE LAW.
9.6 The provision of Virtual Items for use in the Testmyteeth mobile application is a service provided by Testmyteeth that commences immediately upon acceptance by Testmyteeth of your purchase.
9.7 You agree to pay all fees and applicable taxes incurred by you or anyone using an Account registered to you. Testmyteeth may revise the pricing for the Virtual Items offered through the Service at any time. YOU ACKNOWLEDGE THAT TESTMYTEETH IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS WHEN AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY.
10.0 Prohibited Uses
When using the Testmyteeth Website or Mobile Application you must not (nor permit any third party to):
10.1 breach the terms of use in any way.
10.2 breach any applicable regulation, local, national or international law.
10.3 behave any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.
10.4 knowingly transmit, upload or send any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
10.5 attempt to gain unauthorised access to our Services, the server on which our Services are stored or any server, computer or database connected to our Services.
10.6 attack our Sites via a denial-of-service attack or a distributed denial-of service attack.
10.7 interfere with the proper working of our Services, attempt to circumvent security, tamper with, hack into, or otherwise disrupt any computer system, device, server, website, router or any other Internet connected device.
10.8 modify, reverse engineer, decompile or disassemble the Mobile Application or Website.
10.9 behave in a violent, threatening, abusive or offensive manner towards any support personnel, user or other entity.
10.10 access, interfere with, delete, modify, manipulate or remove any Content found on our Website or Mobile Application without authority.
10.11 impersonate any other person or entity.
10.12 use or attempt to use another user’s account without authorisation.
10.13 harvest, solicit, or collect information of other Testmyteeth users for any reason.
10.14 transmit, sell, post, advertise, or promote any unsolicited or unauthorised promotional materials, competitions, products, services or any other form of similar solicitation (spam).
10.15 use our Website or our Mobile Application in any way that, in our sole discretion, interferes, restricts or inhibits any other person from using or enjoying Testmyteeth Services, or which may expose us or our users to any harm or liability of any type.
11.0 Intellectual Property Rights
11.1 “Testmyteeth Content” includes any photos, images, graphics, video, audio, text, educational guides, blog articles, software or other information, content or materials that are provided, published, posted or generated by Testmyteeth Services.
11.2 All Intellectual Property Rights (IPR) including trademarks, patents, and copyright relating to Testmyteeth Content including our branding, logos and the overall design of the Testmyteeth Website and Mobile Application are owned by Testmyteeth Limited and our licensors, unless otherwise indicated.
11.3 You must not (nor assist or facilitate any third party to) copy, imitate, modify, commercially exploit or transmit any Testmyteeth Content without prior written consent by Testmyteeth Limited.
11.4 You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content available through our Services.
11.5 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
11.6 Other trademarks, products, logos, images, graphics, text and names of affiliated companies published through our Services are the property of their respective owners and may not be copied, imitated or used, in whole or in part, without the permission of the applicable trademark holder.
11.7 Content provided by you or a third party (“Your Content”) is the responsibility of the person that submits the content to our Services, except as otherwise set out in these Terms.
11.8 You acknowledge and agree that any Submission (including questions, comments, suggestions, ideas, feedback or other information about our Services) that is provided by you via support@testmyteeth.com, or is otherwise communicated directly by you to Testmyteeth, will be considered non-confidential and non-proprietary. Testmyteeth will be entitled to unrestricted use and dissemination of any Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
11.9 We reserve our right to take any appropriate legal action required to protect or enforce our (or a third party’s) legal rights if you misuse or otherwise abuse our Services or any of the Content in any way, or if you infringe any IPR in any way.
11.10 You acknowledge and agree that we may disclose any Content (including Your Content or Submissions) and/or your identity if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to:
i) comply with legal process, applicable laws or government requests.
ii) enforce these Terms.
iii) respond to claims that any Materials violate the rights of third parties.
iv) protect the rights, property, or personal safety of us, our users and the public.
11.11 You understand that the technical processing and transmission of our Services, including any User Content, may involve:
i) transmissions over various networks.
ii) changes to conform and adapt to technical requirements of connecting networks or devices.
11.12 You agree that you will not use our Intellectual Property Rights in any way other than allowed under these Terms and any infringement by you of our Intellectual Property Rights will be a breach of these Terms.
12.0 Links to External Websites
12.1 We may provide links from our Services to external websites and resources provided by third parties which you can choose to access at your sole discretion and risk.
12.2 If you choose to enter the linked website you acknowledge and accept that Testmyteeth does not review or endorse and is not responsible or liable in any way for the content of such sites (including any advertising, products, text, materials, software and other services they may provide).
12.3 When you access third party sites, you are subject to their terms of use and privacy policies, which we recommend that you review.
12.4 Testmyteeth is not responsible for the availability of any external website or any interruption of services, malfunctions, or security breaches involving these third-party sites.
12.5 These links should not be interpreted as approval by us of those linked websites or information you may obtain from them.
13.0 Linking to Our Website
13.1 You may link to the home page of our Website (www.testmyteeth.com), provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
13.2 You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
13.3 Our Website must not be framed on any other website, nor may you create a link to any part of our Website other than the home page.
13.4 We reserve the right to withdraw linking permission without notice.
13.5 The website in which you are linking must comply in all respects with these Terms, including the terms applicable to User Content in section 8.0.
13.6 If you wish to link to or make any use of the Materials other than that set out above, please contact support@testmyteeth.com.
14.0 Competitions and Giveaways
14.1 Additional terms and conditions may apply to surveys, contests, giveaways, and other promotions sponsored by Testmyteeth or its partners. It is your responsibility to carefully review those terms and conditions.
15.0 Children and young people
15.1 If you are under 16 years old are not permitted to use, create an account or access Testmyteeth Services unless supervised by a parent or legal guardian at all times.
15.2 If you are between 16 and 18 years old, you may create an account and access our services if you have consent from your parent or legal guardian. However, you should only use our Services when supervised by a parent or legal guardian.
16.0 Use outside of the United Kingdom
16.1 Testmyteeth makes no claims that our Mobile Application or Website is appropriate, legal or may be downloaded outside of the United Kingdom. Access to Testmyteeth Services may not be legal by certain persons or in certain countries. If you access the Testmyteeth Mobile Application or Website from outside the United Kingdom, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.
16.2 Although Testmyteeth Services are designed to be accessed remotely by any of our customers, our Services are not designed for non-English speakers.
17.0 Changes to Our Services
17.1 We are constantly changing and improving the Testmyteeth Mobile Application and Website. We may adapt, add or remove functionalities or features, and we may suspend or stop a service offered through the Testmyteeth Mobile Application or the Testmyteeth Website at any time.
17.2 We may also suspend or stop the Testmyteeth Mobile Application and/or Website itself, altogether.
17.3 Testmyteeth is under no obligation to make changes to our Services.
17.4 We do not guarantee that our site, or any content on it, will be free from errors or omissions.
17.5 Testmyteeth reserves the right to determine the timing and content of software updates, which may be automatically downloaded and installed without prior notice to you.
18.0 Termination
18.1 Testmyteeth will determine, in our discretion, whether there has been a breach of these Terms through your use of our Mobile Application or Website.
18.2 Testmyteeth reserves the right, at any time and without notice or liability to you, to take such action as we deem appropriate if a breach of these Terms has occurred including:
i) issuing a warning to you
ii) immediately, temporarily or permanently suspending or deactivating your account
iii) immediately, temporarily or permanently withdrawing your access to certain aspects or all Testmyteeth Services
iv) immediately, temporarily or permanently removing any of Your Content and other information related to your account
v) taking legal action against you for reimbursement of all of our costs resulting from the breach (including, reasonable legal and administrative costs)
vi) disclosing information to law enforcement authorities as we reasonably feel is necessary
18.3 The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.
18.4 You may close your account at any time by contacting us.
19.0 Disclaimers
19.1 Please see our Medical Disclaimer in Section 4.0.
19.2 The content on our Mobile Application and Website is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain advice from a qualified professional before taking or refraining from any action on the basis of any content provided by Testmyteeth Services.
19.3 It shall be your responsibility to ensure that any products, services or information available through our Mobile Application or Website meet your specific requirements.
19.4 We make no warranty that Testmyteeth Services or Content delivered via Testmyteeth Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
19.5 We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of Testmyteeth Services or any Content delivered via Testmyteeth Services.
19.6 Testmyteeth cannot and does not guarantee that our Services will be free from infection, viruses and/or other harmful code.
19.7 As a user of our Services, you are solely responsible for implementing sufficient procedures and virus checks (including anti-virus, firewall and other security protection) on any system or equipment you might use to access our Services. We are not liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Mobile Application or Website or to your downloading of any material posted on it, or on any website linked to it.
20.0 Limitation of Liability
20.1 If you are a consumer, nothing in these Terms affect your statutory rights.
20.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so, including our liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and fraud or fraudulent misrepresentation.
20.3 Testmyteeth only provides our Mobile Application and Website for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
20.4 To the extent permitted by applicable law, Testmyteeth excludes all warranties, conditions, representations (other than fraudulent or negligent misrepresentations) or other terms, whether expressed or implied, which may apply to our Services or any content delivered via our Services, when used for any business or commercial purposes.
20.5 Testmyteeth will not be liable, in contract or tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, for the below mentioned losses where they have arisen from use of or inability to use Testmyteeth Services for commercial purposes, or use of or reliance on any material or content made available via Testmyteeth Services or on any linked websites for commercial purposes:
i) Any economic losses including lost profits, revenues, sales, savings or contracts
ii) Any loss of reputation, business opportunity or goodwill
iii) Any service interruption, loss of data, computer damage or system failure
iv) Any business interruption, wasted office or management time
v) Any indirect or consequential loss or damage.
vi) Any cost of substitute services arising out of or in connection with these terms or from the use of or inability to use Testmyteeth Services
vii) Any other loss or damage of any kind
20.6 Testmyteeth assumes no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
20.7 If we fail to comply with these Terms and you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking our contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
20.8 To the extent permitted by applicable law, if Testmyteeth, our employees or affiliated companies are found to be liable to you in any way whatsoever for any damage or loss which arises in any way out of, or is in any way connected with, your use of our Services, links to or from our Services, or these Terms, our total, aggregate liability shall not exceed the amounts you have paid to Testmyteeth for use of Testmyteeth Services or the total of one hundred pounds (GBP £100), if you have not had any payment obligations to Testmyteeth.
20.9 Some jurisdictions or countries do not allow the above exclusion or limitation of liability so the above limitation 19.8 may not apply to you.
21.0 Indemnity
21.1 You agree to indemnify and hold harmless Testmyteeth, our directors, employees, agents, licensors, affiliates and contractors in respect of all claims, fines, penalties, actions, demands, disputes, allegations, liabilities, damages, losses, costs, expenses or investigations brought by any third party, governmental authority, or industry body, including without limitation reasonable attorneys’ fees, arising out of or in any way connected with:
i) your access to or use of Testmyteeth Services.
ii) Your Content.
iii) Your breach or alleged breach of any warranties made by you or your breach of any of these Terms.
iv) Your violation of any law or the rights of a third-party. We reserve the right to assume control of the defence of any third-party claim that is subject to indemnification by you, in which event you will cooperate with us in asserting any available defences.
22.0 Applicable Law
22.1 If you are a consumer, these Terms are governed by the laws of England and Wales. However, if you are a resident of Ireland you will benefit from any mandatory provisions of the law of Ireland. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.
22.2 You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, if you are resident of Scotland, you may also bring proceedings in Scotland, and if you are resident in Ireland, you may also bring proceedings in Ireland.
22.3 If you are a business, these Terms (and any non-contractual disputes or claims) are governed by the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction over legal proceedings in connection with your use of our Services, any breach of these Terms and any question in connection with the interpretation or application of these Terms.

Headings in this Agreement are intended for convenience of reference only.
Forms of words will be construed to include singular or plural, and any gender, masculine, feminine, or neutral, as the context requires, and “including” means “including but not limited to”.
Reference to a person includes an individual, corporation, trust or statutory body.
Nothing in this Agreement will be construed as creating a relationship of partnership, of principal and agent or of trustee and beneficiary between you and Testmyteeth.
Any provision of this Agreement (or any part thereof) which is invalid in any jurisdiction must, in relation to that jurisdiction:
be read down to the minimum extent necessary to achieve its validity, if applicable; and
be severed from this Agreement in any other case, without invalidating or affecting the remaining provisions of this Agreement or the validity of that provision in any other jurisdiction.
No amendment to, or waiver of right under, this Agreement is effective unless in writing signed by the authorised representatives of the parties.
25.0 Definitions
Content means any content, information or materials available through the Testmyteeth Mobile Application, Testmyteeth Website, Testmyteeth Social Media or other communications with Testmyteeth Limited.
Testmyteeth Mobile Application means the Testmyteeth branded mobile application available for download through the Apple App Store or Google Play.
Third Party Information means all Content supplied by a third party and incorporated into the Testmyteeth Mobile Application and Website, including any information relating to services provided by dental professionals.
